TERMS & CONDITIONS OF USE OF THE WEBSITE

The owner of the online store upeathiukset.fi is Norsten OÜ (Reg. code: 16158045), located at Vahi str. 33, Vahi village, Harku parish, Harju County 76901, Estonia; info@upeathiukset.fi.

  1. These terms and conditions apply when making purchases in the online store upeathiukset.fi.
  2. In addition to these terms, the legal relations arising from the purchase of products from the upeathiukset.fi online store are governed by the laws of the Republic of Estonia.
  3. Norsten OÜ reserves the right to make changes to the terms and conditions. Any changes will be communicated on the upeathiukset.fi website.
  1. The prices of the products sold in the online store are indicated next to the products. All prices listed on the upeathiukset.fi online store are in euros and include 25,5% VAT.
  2. A shipping fee will be added to purchases based on the chosen delivery method and location. The delivery fee will be displayed during the checkout process.
  3. Norsten OÜ reserves the right to make changes to the sales prices. These changes will be reflected on the upeathiukset.fi website.
  4. Product availability may change at any time without notice. If the ordered item cannot be delivered due to it being out of stock or for any other reason, the Buyer will be informed as soon as possible, and the paid amount (including delivery costs) will be refunded promptly, but no later than 14 days from the date of notification.
  1. To make a purchase, add the desired product to your shopping cart and complete the order by filling in all the required fields. Please fill in the information carefully, as the accuracy of the provided details ensures the prompt and error-free delivery of products and the resolution of any disputes or claims.
  2. Choose the appropriate delivery method. Products are delivered within the Republic of Finland.
  3. Delivery to parcel terminals within Finland is free for orders over €89.
  4. Pay for your purchase using the following payment methods:
    1. Finnish bank links: Aktia, Danske Bank, Handelsbanken, Nordea, POP Pankki, S-Pankki, Säästöpankki, Alandsbanken
    2. PayPal
    3. Apple Pay, Google Pay, Revolut, N26, or credit card
    4. Note: When paying via bank link, be sure to click the “Return to Merchant” button on the bank’s page.
  5. Payments are processed by Montonio Finance UAB, Maksekeskus AS, or PayPal. Payment takes place outside of the online store in a secure environment—via the respective bank’s secure environment for bank link payments and in Montonio Finance UAB, Maksekeskus AS, or PayPal’s secure environment for credit card payments. The seller does not have access to the customer’s bank or credit card information. The contract is considered concluded once the payment amount is received in the online store’s bank account.

  6. The online store owner is the controller of personal data and will forward the necessary personal data for payment processing to the authorized processors Montonio Finance UAB, Maksekeskus AS, or PayPal.

  7. Orders placed in the Norsten OÜ online store are processed on business days, Mon−Fri, 9:00−17:00.

  8. Orders that have not been paid for will be canceled 24 hours after the order is placed.

  9. Norsten OÜ ships products after the invoice is paid.

  10. The sales contract is considered concluded once the payment made by the consumer is received in Norsten OÜ’s bank account.

  1. After the sales contract is concluded, Norsten OÜ will process the order and hand it over to its logistics partners Posti or DPD for delivery.
  2. Posti is Finland’s leading delivery service with an extensive network of more than 1500 service points. You will receive an SMS notification when your parcel is ready for collection.
  3. Delivery cost to Posti parcels is 5,99€ (incl. VAT).
  4. Orders placed before 15:00 on weekdays will be dispatched the same day. Orders are expected to arrive within 1-3 business days (Helsinki and surrounding areas) or within 2-5 business days (rest of Finland).
  5. Orders placed after 15:00, or weekends or public holidays will be dispatched on the next working day.
  6. If there is a delay in the shipment for any reason, Norsten OÜ will coordinate with the Buyer to agree on a suitable delivery time.
  7. Norsten OÜ is not responsible for delays in delivery if the goods were handed over to the logistics partners on time, but the delay is due to circumstances beyond Norsten OÜ’s control or ability to foresee.
  1. Products purchased from the Norsten OÜ online store are subject to a 14-day right of withdrawal from the date of receipt. If a product ordered from the online store is not suitable for the Buyer, they may return it without providing a reason, except in the following cases:
    1. The right of withdrawal does not apply if the Buyer is a legal entity.
    2. The withdrawal period ends 14 days after the day on which the Buyer, or a third party designated by the Buyer who is not the logistics partner of Norsten OÜ, has physically taken possession of the products.
    3. The right of withdrawal does not apply if the products have been delivered in sealed packaging, are not suitable for return due to health protection or hygiene reasons, and have been opened after delivery (e.g., cosmetic products).
  2. To return the goods, the Buyer must submit a withdrawal statement in free form via email to info@upeathiukset.fi or use the return form provided below, no later than 14 days after receiving the goods.

  3. Norsten OÜ will refund the Buyer the cost of the returned product without delay, but no later than 14 days from the day Norsten OÜ is informed of the Buyer’s decision to return the product.

  4. The cost of returning the goods will be borne by the Buyer, except in cases where the returned goods do not correspond to the order (e.g., the wrong product or a defective product).

  5. The Buyer must return the product to Norsten OÜ without delay, but no later than 14 days from the day they informed Norsten OÜ of their wish to return the product. The product can be returned via Posti or DPD parcel terminals.

  6. Norsten OÜ reserves the right to withhold the refund until the product has been returned or the Buyer has provided proof of having returned the product, whichever occurs first.

  1. Norsten OÜ is responsible for any non-conformity or defect in the product sold to the Buyer that existed at the time of delivery to the Buyer. For the first month after the product is delivered to the Buyer, it is presumed that the defect existed at the time of delivery. It is the responsibility of Norsten OÜ to refute this presumption.
  2. The Buyer has the right to submit a claim to Norsten OÜ within 1 month of the defect’s discovery by sending an email to info@upeathiukset.fi. In the email, please include the name of the person who placed the order, contact phone number, order number, and a detailed description of the non-conformity or defect, along with a photo that clearly shows the defect.
  3. If the product purchased from the Norsten OÜ online store is defective, Norsten OÜ will replace the defective product or provide special discount from next order, as it’s more suitable for the Buyer. If the product cannot be repaired or replaced, Norsten OÜ will refund the Buyer for all payments associated with the sales contract.
  4. Norsten OÜ is not responsible for defects caused by the Buyer due to improper storage or misuse of the product.
  5. All claims will be reviewed, and the Buyer will be contacted as soon as possible, but no later than 14 days after the claim is received.
  6. If Norsten OÜ has refused to resolve the Buyer’s complaint or if the Buyer is not satisfied with the proposed solution and believes that their rights have been violated or their interests harmed, the Buyer may submit a complaint to the Consumer Disputes Committee through the Consumer Protection Board or to a court. The Buyer may submit the complaint personally or through a representative. Information on the Consumer Disputes Committee can be found on the Consumer Protection Board’s website. For resolving issues arising within the European Union, the Buyer can contact the European Consumer Centre.

Norsten OÜ is not liable for any damage or delays in the delivery of the product if the damage or delay is caused by circumstances beyond Norsten OÜ’s control or ability to foresee.

  1. Norsten OÜ is the controller of personal data and uses the personal data entered by the Buyer only for fulfilling the order and delivering the goods to the Buyer. Norsten OÜ transmits the necessary personal data for payment processing to the authorized processors and to the logistics companies for the delivery of the goods.
  2. The personal data processed includes the Buyer’s name, address, email address, mobile phone number, and consumption preferences.
  3. Norsten OÜ will send newsletters and offers to the Buyer’s email address only if the Buyer has expressed a desire to receive them by entering their email address on the website and indicating their wish to receive direct marketing communications.
  4. The Buyer has the right to prohibit the collection and use of their personal data at any time, except when it is necessary for enforcing a claim arising from the contract or for delivering the goods. The consent for the use of personal data cannot be withdrawn retroactively.
  5. An encrypted data communication channel with banks ensures the security of the Buyer’s personal data and bank details during purchases, and Norsten OÜ’s online store does not have access to this information.

The present terms and conditions are valid from October 1, 2024.
